Please read these terms carefully before using WinMyCase. By accessing or using our services, you agree to be bound by these Terms of Service.

Welcome to WinMyCase (the “Platform”), operated by WinMyCase (“we,” “us,” “our,” or “WinMyCase”).

By accessing or using the website https://winmycase.in (including all subpages, features, and mobile-responsive interfaces), any associated applications, services, or tools (collectively, the “Services”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, you must not access or use the Services.

These Terms constitute a legally binding agreement between you and WinMyCase. Please read them carefully.

1. Definitions

“User,” “you,” or “your” means any individual or entity accessing or using the Services.

“Content” means any text, documents, uploads, grievance details, RTI requests, petitions, voice notes, IDs, or other materials you submit or generate through the Services.

“Services” includes grievance drafting, filing assistance, escalation (including CM/PM petitions), tracking dashboard, IntegrityDesk, Shielded RTI, guides, expert chat support, and any related administrative or technology-enabled features.

“Grievance” means any complaint, petition, RTI application, or dispute you file through the Platform with government, regulatory, or other authorities.

2. Eligibility and Account Registration

You must be at least 18 years of age and fully competent to enter into a binding contract under Indian law. The Services are not intended for or directed at individuals under 18; we do not knowingly collect data from minors. To use certain Services, you may need to create an account. You agree to:

We reserve the right to suspend or terminate accounts that provide false information or violate these Terms.

Provide accurate, complete, and current information.

Maintain the confidentiality of your account credentials.

Notify us immediately of any unauthorized use of your account.

3. Description of Services

WinMyCase is a civic-legal technology platform that provides administrative and documentation assistance for filing and tracking grievances, RTIs, petitions, and workplace reports (IntegrityDesk). We use AI combined with legal experts to draft documents and facilitate escalations, but:

Our role is strictly limited to documentation, drafting based on your inputs, electronic or physical filing assistance, tracking, and follow-up coordination.

We are not a law firm.

We do not provide legal advice, legal opinions, representation, or advocacy.

No attorney-client or advocate-client relationship is created by your use of the Services.

All outcomes depend entirely on the relevant government, regulatory, or judicial authorities. We offer no guarantees regarding resolution, timelines, or success of any Grievance.

4. User Representations and Responsibilities

By using the Services, you represent and warrant that:

You are solely responsible for the accuracy and legality of your Content and any Grievance filed on your behalf.

All information and Content you provide is accurate, truthful, and not misleading.

You have the legal right to submit any documents, IDs, or information uploaded.

Your use complies with all applicable Indian laws, including the Information Technology Act, 2000, Digital Personal Data Protection Act, 2023 (DPDPA), and relevant grievance/RTI statutes.

You will not use the Services to file frivolous, false, malicious, or defamatory Grievances.

5. Prohibited Uses

You agree not to:

Violation may result in immediate termination of access and reporting to authorities where required.

Use the Services for any illegal, fraudulent, or unauthorized purpose.

Upload viruses, malware, or harmful code.

Attempt to reverse-engineer, copy, or scrape the Platform.

Interfere with or disrupt the Services or any third-party systems (including government portals).

Impersonate any person or entity.

Submit Content that violates any third-party rights or is defamatory, obscene, or harassing.

6. Intellectual Property

The Platform, its design, logos, software, AI tools, and all content (except your User Content) are owned by or licensed to WinMyCase and protected by Indian and international copyright, trademark, and other laws.

You retain ownership of your Content. By submitting Content, you grant WinMyCase a worldwide, non-exclusive, royalty-free, perpetual license to use, host, reproduce, modify (for drafting purposes), distribute, and display it solely as necessary to provide the Services and comply with legal obligations.

7. Payments, Billing, and Refunds

Certain Services require payment. Pricing is displayed at the time of purchase and may be updated with notice. All payments are processed through secure third-party payment gateways. You agree to:

Refund Policy: Refunds are governed exclusively by our separate Refund Policy. Refunds are granted only on a case-by-case basis when no significant work has begun and failure is solely attributable to WinMyCase. Once drafting or filing preparation starts, services are generally non-cancellable and non-refundable. Processing of approved refunds occurs within 7–14 business days via the original payment method.

You agree not to initiate chargebacks or disputes with your bank/card issuer except as permitted under the Refund Policy. Unauthorized chargebacks may result in account suspension and legal action.

Pay all applicable fees, taxes, and charges.

Provide valid payment information.

Authorize us (or the gateway) to charge your chosen payment method.

8. Privacy and Data Protection

Your privacy is governed by our Privacy Policy, which is incorporated by reference. By using the Services, you consent to the collection, use, processing, and sharing of your personal and grievance-related data as described therein (including sharing with payment gateways and government authorities for filing purposes).

We process data in compliance with the DPDPA 2023 and other applicable laws. For Shielded RTI and IntegrityDesk, additional explicit consent and encryption measures apply.

9. Disclaimers and No Warranties

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT ANY WARRANTIES, EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ACCURACY OF OUTCOMES. We do not warrant:

That any Grievance will be accepted, resolved, or resolved within any timeframe.

Uninterrupted or error-free operation of the Platform.

That government portals or authorities will function without downtime.

10. Limitation of Liability

To the maximum extent permitted by law, WinMyCase and its affiliates, officers, directors, employees, agents, and licensors shall not be liable for any indirect, incidental, special, consequential, or punitive damages (including loss of profits, data, or Grievance outcomes).

Our total aggregate liability shall not exceed the amount you paid to us for the specific Service giving rise to the claim in the twelve (12) months preceding the claim.

11. Indemnification

You agree to indemnify, defend, and hold harmless WinMyCase and its personnel from any claims, losses, damages, liabilities, and expenses (including legal fees) arising out of:

Your violation of these Terms.

Your Content or Grievance.

Your breach of any law or third-party rights.

Any chargeback or payment dispute you initiate improperly.

12. Termination

We may terminate or suspend your access to the Services at any time, with or without notice, for any reason (including violation of these Terms). Upon termination, your right to use the Services ceases immediately, but any provisions that by nature survive (payments, disclaimers, liability, indemnification, governing law) shall continue.

You may stop using the Services at any time.

13. Changes to These Terms

We may update these Terms from time to time. We will notify you by posting the revised version on the Platform with a new “Last Updated” date. Continued use of the Services after changes constitutes your acceptance of the revised Terms.

14. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising out of or in connection with these Terms or the Services shall be subject to the exclusive jurisdiction of the competent courts located in Chennai, Tamil Nadu.

15. Miscellaneous

Severability: If any provision is held invalid, the remainder shall continue in full force.

No Waiver: Our failure to enforce any right does not constitute a waiver.

Assignment: You may not assign these Terms without our prior written consent. We may assign freely.

Force Majeure: We are not liable for delays or failures caused by events beyond our reasonable control (including government portal outages, strikes, or natural disasters).

Entire Agreement: These Terms, together with the Privacy Policy and Refund Policy, constitute the entire agreement between you and WinMyCase.
